IN TERMS OF SECTION 11 OF THE ELECTRONIC COMMUNICATIONS AND TRANSACTIONS (ECT) ACT 25 OF 2002 AND THE COMMON LAW OF CONTRACT, THESE TERMS AND CONDITIONS ARE VALID, BINDING AND ENFORCEABLE AGAINST ALL PERSONS THAT ACCESS THE TECHNEWS WEBSITE OR USE THE SERVICE THROUGH THE GALLIVANT AFRICA WEBSITE OR ANY PART THEREOF. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MUST LEAVE THE WEBSITE(S) IMMEDIATELY AS FURTHER USE WILL AUTOMATICALLY BIND YOU TO THESE TERMS AND CONDITIONS.
Definitions and interpretation
- a) “Gallivant Africa” means Gallivant Africa Media (Pty) Ltd, reg. no. 2017/173015/07 of 80 Ferero Ave, Randpark Ridge, 2169, South Africa;
- b) “Website” means the Gallivant Africa website and the magazine and directory sites owned and operated by Gallivant Africa, including: i) gallivant.africa; ii) tv.gallivant.africa; iii) radio.gallivant.africa
- c) “User” means any person who enters or uses the Website;
- d) References herein to the singular includes the plural and vice versa; and e) Hyperlinks herein to legal documents should be deemed part of these terms and conditions in terms of section 11(3) of the ECT Act. The fact that some or all of the hyperlinks may, from time to time, be non-operational, shall not affect the validity and interpretation of these terms and conditions.
By registering to use the Services, users agree that any post deemed inappropriate may be removed at the sole discretion of Gallivant Africa. Gallivant Africa also has the right, at its sole discretion, to revoke use of the Services at any time without notice or reason. In simple terms: if you break the rules, you will be banned. Exploiting loopholes to circumvent rules will also result in a ban. Gallivant Africa is not responsible for any user-uploaded content. Unless expressly stated otherwise, this includes content posted by Gallivant Africa’s personnel, agents, representatives et al. Gallivant Africa reserves the right to reveal the identity of or whatever information we know about any user in the event of a complaint or legal action arising from any content posted by said user.
Profanity. Profanity of any kind, whether in pictures or in text (including in usernames), is strictly prohibited. Further, profanity directed in an attack against another party may result in warning or ban.
Copyrighted Material. Uploading any copyrighted material or using the Services in a way that circumvents any copyright laws is prohibited and grounds for an immediate ban. Users agree not to upload any material that is protected by copyright, trademark or other proprietary right without the express permission of the owner(s) of said copyright, trademark or other proprietary right. In appropriate circumstances, Gallivant Africa will also terminate your account if you are determined to be a repeat infringer. Any content from outside locations is permitted as long as it abides by their (and our) permissions.
Bans. Ban times will be increased for repeat offenses. We will only discuss the nature, reason, and length of a ban with the user banned. If you log onto the Gallivant Africa site and receive a message that you have been banned, please note the reason and time and wait for the ban to end. If you believe the ban is in error, you may contact Gallivant Africa at hello@gallivant.africa. Your ban will then go through a review process and you will be notified within 7 days of the review’s outcome. It is Gallivant Africa’s standard practice to increase ban times for repeat offenders. Taking any action while banned other than privately disputing a ban claim (including posting /reporting other users) on an alternate username is not permitted, and will result in an extension of the current ban.
Nudity, Pornography, Pedophilia & Sexually Explicit Content. Absolutely no forms of pornography are allowed on the Gallivant Africa site. Media that contains sexual acts, pubic hair, female nipples, nude or seemingly nude people, bodily fluids or genitals that are in any way visible (even through clothing) is not permitted. The use of unaltered classic art (excluding photographs/videos of people or acts depicting pornographic material) is allowed, if uploaded for the sake of expression and not for the sole purpose of circumventing a ban on otherwise banned content. However, content may be removed if Gallivant Africa determines, in its sole discretion, that such content violates guidelines.
Racism, Sexism and Hate. Content that is racist, sexist, or otherwise discriminatory is not permitted on the Gallivant Africa site, and is subject to a warning or ban.
Questionable Content. Since we cannot have a rule to cover everything, this is the rule to cover everything. This is a public site, so act like you would if you were in a public place. A nice place! These issues are left to the discretion of Gallivant Africa, but may include any material that is knowingly defamatory, abusive, vulgar, hateful, harassing, sexist, obscene, racist, profane, sexually oriented, threatening, invasive of a person’s privacy, that otherwise violates any law, or that encourages conduct constituting a criminal offense. Uploading any of the material listed above is not permitted.
Due to the volume of uploads, Gallivant Africa cannot promise you will receive a warning every time action has to be taken.
Use of Your Content. By registering for the Services, you agree that any uploaded content will not be deemed confidential or proprietary. Further, you grant Gallivant Africa irrevocable and unlimited right to use, publish, reproduce, modify, or distribute your content (or any concepts derived from or contained therein) on its sites or in related media, with or without your name, and without any payments to you. You represent that you own any content you upload and/or have the appropriate authority or permissions to grant this license to Gallivant Africa for such uploaded content, without restriction, from any party who: (i) appears in your content; or, (ii) owns rights to your content.
Acceptable Use of the Services. Users acknowledge and agree that the Services are strictly for personal use and entertainment purposes. Commercial use of the Services is not permitted under any circumstance and may result in warning or ban.
Limitation of Liability. Users shall be liable and shall indemnify Gallivant Africa against any and all threatened or actual claims, actions, liabilities, losses, damages, expenses (including reasonable attorney’s fees) incurred by Gallivant Africa which directly or indirectly arise from a user’s breach of any of the herein terms and conditions.
